A COURT FOR TERRORISTS IS NEEDED

A new war is fought: A state is not attacked by another state. The attacker is an individual, the terrorists, or a league of terrorists that may belong to several different States. The subject himself, the terrorist, has also changed; he is not the same historic subject " who has spread his idea by the means of the fact" for the last 150 years. Today, he prefers not to proclaim he was the author, or to boast about his crime, duplicating terror hiding his identity. International Law, conceived to control relationships among States, to reconcile and punish, is inadequate because it does not reach to the individuals, the terrorist who strikes a State. The first conclusion is to legislate right away and create an International Penal Court, which will hold enough power to judge and punish criminals, as the ones who attacked last September 11 th .

"The dream of an International Penal Court, entitled to judge to the most dangerous criminals, is about to become true. The Court's Code was approved in Rome in 1998, It has been signed by more than 90 countries, and 5 have already ratified It. The Court will be established once its guidelines have been ratified by 60 countries. The Court's jurisdiction will be over crimes of war and against mankind. There is still a long way to go ... judicial details, which may have a great deal of effect on Courts effectiveness, must be agreed on in International Conferences. The Code must be ratified, which will demand constitutional arrangements in many countries. The United States of America, a key country, up until now, has refused to join to the Court!. This is the chance for the United States of America, once its position has been reviewed, to support the creation of this Court, which currently is a must to judge Osama Ben Laden. It is irregular to keep on artificially creating, for each new crime or scenario, a new Tribunal of Justice: The last one the International Tribunal for Yugoslavia.

The lack of an International Penal Court to judge individuals is leading the United States to make justice by its own hand and, though Its decision not to affect Afghan civilian inhabitants, to Incur in excesses. Having announced that bomb rides will continue until next summer, it is understood that they will continue though the lack of military targets and that their goal is to strike on Afghan territory, as the victim who blindly and tenaciously knocks on the door complaining against the criminal. But, it is also a fact that, as Ben Laden has accepted his responsibility, the Taliban government is his accomplice: Being able to surrender the terrorist, if not to the United States of America, but to a neutral government, the Taliban has no right to complain for the victims who are the consequence of its tenacious and persistent stubbornness. Ben Laden himself, who is rushing the death and wreckage of the people he proclaims to defend, should take part and surrender himself, either to Switzerland or Brazil, for instance. Neutral governments should offer their assistance for this good cause. There is no ethic on standing still.

SIGNIFICANCE OF THE DIVINE DELAY

Up until Friday when this article was written, the American Government has successfully carried out its duties. General Powell does not deserve recognition for Iraq's war, but currently he does not allow the development of another usual war, which always kills innocent people. Iraq's was a mediocre war for Kuwait's oil and without heroism. It was the first time that confronting generals did not see each other; USA firing from long distances. The American Army shall be at service for morale values; it shall never again support any economical issues. President Bush is right to stand by the creation of the Palestinian state and correspondent feeding actions of Afghan refugees. This is the formula to cease terrorism: it shall be surprised with generosity, and unexpected virtues shall also be shown. I see no difference between Sharon and Ben Laden and it is a historic fact that terrorists such as Arafat and Begin have turned into rewarded state men. New York's tragedy will be productive, therefore a lot less painful for mankind if, at least, Tel Aviv and Kabul governments are changed, and the Arab-Palestinian warfare comes to an end. Jewish extremists' pretension to take over Jerusalem is a way of profiteering. It is a contradiction to takeover the arc of the alliance, which therefore ends up in the arc of disagreement. Their contempt for Palestine is the same racist disdain they were victims of, before. Exemplary Israeli state men: Rabin and Barak.

Among monotheist religions, only one, Christians, accepts that their God, Jesus Christ, has already come. On the other hand, Muslims and Hebrews are still waiting for their God to come: the Mahdi or the Messiah, respectively. This religious belief has an extraordinary political significance!. Because of the fact that, in the Eastern, Muslim or Hebrew World, any honest person may believe himself as the Mahdi or Messiah, and carry on with sensationalist acts; no doubt the most sensational of them all, to strike to the World's Mightiest Country, just for being that, but even more notorious if aforementioned nation had accomplished some excesses of power that produced such a damage to the people who shared their own religious belief. And, of course, the more powerful, bright or kind that person is or believes he is, in his Messianic career to fill in God's shoes, he will see himself as Jesus Christ's rival, thus any action against Christians is worth the effort. The risk is even greater if that religious leader may access the political power, as it happens in the Muslim World, because, being in charge of a State's political power, he will be tempted to promote conflicts against Christian countries. God has been used as a political weapon by fundamentalist Muslims. The Western World shall focus on a centennial educational campaign, by the means of radio and television, backing and promoting respect for all religious believes, and mainly the separation of the Church and the State, encouraging all nations to forbid priests to participate in the political field, as it happens in the Western World.

The World is at risk because of the delay of two Gods.

SUCH A TRAGEDY SHALL NOT BE REPEATED

Such a tragedy the world is mourning about, condemn is the unanimous and fair claim, not enough though. It shall be asked: "Why did it happen?" "What shall be done, without sacrificing principles, not to happen again?" "Have we contributed to make our enemy feel mad by our constant annoying?" "is it possible to hate that much without any basis?" If we do not search, if we do not go any further than the mere reprisal, it will happen again. Carthage may have been destroyed by Rome forever, but an enemy without a certain name, identity or territory; an opponent split in several continents, like the mythological hydra; an invisible rival; a passion, is hard to extinguish. If we cannot find it, at least, we should be aware of its motives. Due to above mentioned facts, it is hard to rest responsibilities on, but a fact that may produce such an equal tragedy may be appointed.

USA must be the referee of the political universe, with greater responsibilities in the current unipolar world. What a mistake it will be, K it takes side with either one of the parties in conflict as it happens with the Muslim Hebrew confrontation, known as the Palestinian-Israeli, This is not just a political conflict but a racial and religious one, and the political mistake of supporting the Israeli monopolizing of Jerusalem, the opposition to the creation of the Palestinian state, disobedience of the United Nations resolutions, ends up in a religious insult which produces the Muslim world's solidarity, and a racial challenge to the Arabic world.

In 1993, New York Twin Towers experienced their first attack, and it was an error to believe that, due to their author legal processing, a Muslim fundamentalist, that symbol would not be attacked again. The seed of the terrorism is not planted in just one man. The collective, multitudinous hatred will produce one and another terrorist leader, one suicidal-killer after another., pedestrian or pilot.

America, the land of the races, and its Christian people, do not have to suffer the consequences of the Arab-Jewish religious and racial war, nor the vicissitudes and caprices of the Israeli democracy. The Jewish community located in America, a prominent pad of the American population, and whose economical support is an outstanding factor in the election of American presidents, must think about this. As natural as it is to support their distant, original country, such an example in some aspects, shall encourage its moderate politicians, and contribute to restrain military excesses. Recognition of the Palestinian state and the condominium of Jerusalem or, better, its administration by the United Nations-, are the circumstances of the peace that should be supported by this community, for principles and convenience; a possible peace and deserved by these three religious cohabitant worlds: Christian, Muslim, Hebrew. The solution of this conflict must be requested by the American people.

In a common cause with the American people, I think about this tragedy not to happen again.

MONUMENT TO THE MISSING SOLDIER

USA shall choose between two positions. The first one: a usual, fast and unfair war, sacrificing a country with only one purpose to capture an individual, who may be seized by a commando. The second one: a long-term fair war, which objective is the identification, localization and punishment of terrorist groups in any country. There is an abyss between the two positions and only the second one is ethical.

Tragedy is such a tutor and only dummies waste its lessons. Its first message is: USA should be an impartial actor in the Palestinian-Israeli conflict and do more: Bring about Israel to respect UNO's resolutions. Additionally, cease Iraq's capricious bombing. Being the unquestionable and rational lesson of the tragedy, due to the fact that, those are USA's wrongdoings, therefore rectifying is a must. A boxer supports a low punch but he does not display his courage getting off the ring in order to punch anybody in the audience. Invade or bomb any country without proof that its government is involved in the attack is just "a saddle on another saddle", tie up a mistake with another mistake, and multiply terrorist bands. USA and the civilized world should join forces to look for the hidden terrorists. However, should USA bomb Afghanistan and a newly born battalion of terrorists will shamelessly go to New York, again. The talibans have already turned down Buddha's huge statues. It is absurd to place a continent's fate in just one man's hands, which is the case of Usama Ben Laden, being aware of the fact that he is the alter ego of a multitudinous hatred; the current existence of leaders with greater resentment and power than him; that hate will be placed in dozens of apostles.

The tragedy shows how a few individuals can cause severe damage by the means of rustic weapons such as knives and unarmed planes. Governments usually consider atomic weapons, cosmic rockets and atmospheric shields. Terrorists do not: a surprise attack manipulating the permanent fear factor inherent to every person, is enough.

The tragedy shows how important the human body is. Sadness rests in the dead body of the love one, Finds comfort in the localization of its tombstone. But pain is infinite when its remains are undisclosed. That is the kind of pain caused by the state terrorism in South America when its dead enemies were hidden. The same pain suffered by each and every one of the relatives mourning the 6,000 dead ones in New York, who are also political victims.

New York is also Latino American: hospital, theater, hotel, wardrobe, our university. Deserves to be defended, even if it was not. Therefore political mistakes related to Jerusalem or Bagdad shall not be paid anymore. As the monument for the unknown soldier whose remains were rescued without a chance for identification, was raised, in New York a monument for the new soldier shall be raised: the urban soldier whose remains were missed but whose identity Is known. This will be the universal tribute for each and every one of the workers killed in the twin towers and planes which were transformed in demolishing fire dungeons

THE GRAPE IS NOT GUILTY

Ecuador should have complained to the Colombian government when avoiding surrendered its rights on the border zone to the guerrilla army, since Colombia allowed its regular army to be substituted by rebel army in the border and faced them with the Ecuadorian army, therefore Ecuador was responsible for the first shot of the war.
Ecuador used to have a border with Colombia, nowadays its border is with three revolutionary commandants. Ecuador, which often paid a high price for a peaceful neighboring with Colombia, giving up territories in 1916, which were lately given up to Peru, realizing today about its sterile territorial sacrifice. Ecuadorian army, which is supposed to have an educated, elemental common relationship with the
Colombian army in order to achieve the border integration, has been compelled to gather up to ten thousand soldiers - risking the national security, in a but different task than its original objective: chase the three invisible and irregular Colombian armies.
Colombia Plan is but an ideological war against rebel armies, which were the product of social injustices that Colombian governments could not overcome- United Sates is fighting them, first of all, because they are communist; and, Colombia, first of all, because they are rebels. In second place is the drug. United States is fighting them since they cannot accept that the grape is not guilty of the hang over, as cocaine is not responsible for its addicts; and Colombia is chasing them because it is bread and money by the rebels. Colombian government, aware of the fact that a solution requires an army, has not so reluctantly retreated its army, on the assumption that the Ecuadorian army is the expendable army they were expecting. The Ecuadorian President shall request from Colombia to relocate its regular army all along the borders facing them between Ecuador and the "free zone" , therefore demanding the American government's support This is the first element of the "Ecuador Plan". How could Colombian government, which has a 200,000 army, claim to be in disadvantage against a 34.000 guerrilla-men army? This is an original case where a comfortable government deliberately left the border so its rebel armies, fighting against the State, may cross to the neighbor, Ecuador, which is then turned into a refuge, and also a place for resting and get supplies for rebel armies, It means that a state sets its penitentiary in the border line, totally closed on the Ecuadorian side with towers, mines, wires, lights and huge escape gates to Colombia.
When Colombia Plan is performed, Ecuador would be doing right by sheltering the civilian fugitives. However, should guerrilla men have the same treatment? Or does Colombian army assume that, by principle, Ecuadorian army will shoot, putting them between two lines of fire? And, will the Colombia Plan inevitably affect Ecuador, surrendering: 1) The crops of narcotic plants and drug industry and al its hell; 2) Civilian population running away from the war; and 3) Rebel armies, it they were defeated.
The Uruguayan President had a good initiative by inviting to American governments to accept that the only way to end up with drug dealing is not to encourage it Drug should be free! Freely supplied by producing states and freely distributed to the ill people! Ecuador should promote and support the idea, first in every Latin American International Affairs Secretaries, a collective pronouncement based on the idea of the Uruguayan President, in order to convince the American government that this is the only solution, since Ecuador is under the siege of mortal danger.
